The following General Terms and Conditions of Sale govern the offer and sale, together with the Terms of Use and the Privacy Policy, of products purchased on the website www.etruscagioielli.com (hereinafter the “Site”). These General Terms and Conditions of Sale are drafted in accordance with the provisions of the Italian Civil Code, Legislative Decree no. 70/2014 concerning information society services and electronic commerce, and the Consumer Code, and govern the offer and sale of products through the website www.etruscagioielli.com.
The products sold on www.etruscagioielli.com are sold directly by Milor S.p.A., with registered office at Via dei Gracchi 35, Milan, registered with the Companies Register of the Milan Chamber of Commerce, Tax Code / VAT no. 04362490155 (hereinafter, for the sake of brevity, the “Seller”).

The online sales service is available only for the countries for which the Site provides such service, provided that such country corresponds to the User’s country of registration.
Purchase requests from countries not included among those displayed on the splash page cannot be accepted by the Seller.

These General Terms and Conditions of Sale form an integral and essential part of the sales contract between the Seller and the User.
The electronic submission of an order by the User implies full knowledge and complete acceptance of these General Terms and Conditions of Sale, the Terms of Use, and the Privacy Policy. If the User does not agree with one or more of the terms contained in these General Terms and Conditions of Sale, they are requested to refrain from making purchases on the Site.
In order to purchase one or more products online, the User must provide the Seller, in compliance with personal data protection regulations, with all the data necessary to enable the Seller to process the submitted orders. To complete the purchase, the User is required to confirm payment of the price of the products placed in the shopping cart. Orders for which the corresponding transaction is not recorded are automatically cancelled.
When the User places an order, they will receive an email containing confirmation of receipt of the order and a summary of the same: however, such communication shall not constitute automatic acceptance of the order.
The Seller reserves the right to refuse orders that are incomplete or incorrect, or from users with whom there is an ongoing dispute relating to the payment of a previous order. In such cases, the User will receive an email notifying them of the refusal of the order, with specific reasons.
If the products displayed on the Site are no longer available at the time of the User’s last access to the Site or upon submission of the order, the Seller shall inform the User, within 5 days from the day following the day on which the order is submitted, of the unavailability of the ordered product. If payment has already been made, the Seller shall refund the price without being liable for any further compensation.
The order form contains a reference to these General Terms and Conditions of Sale and to the Privacy Policy, as well as a summary of the essential characteristics of each product ordered and its price, the accepted payment methods, the delivery methods for the purchased products, shipping costs, the conditions for exercising the right of withdrawal, and the methods and timing for returning purchased products.
The User may, at any time, monitor the status of their order by consulting the appropriate link/section or by accessing their personal account area.
The contract languages are Italian and English.

The products offered for sale through the Site are exclusively first-quality products. The Seller does not sell second-hand products, irregular products, or products of quality lower than the corresponding standards offered on the market.
The essential characteristics of the products are presented on www.etruscagioielli.com within each product sheet. However, the images and colors of the products offered for sale on www.etruscagioielli.com may not correspond exactly to the actual ones due to the Internet browser and monitor used. Product prices may be subject to updates. Please verify the final sale price before submitting the relevant order form.
All products are equipped with an identification tag. We ask you not to remove the tag and the related seal from the purchased products, of which they form an integral part. The product catalog may be updated and modified periodically; therefore, the continued availability of a product among those available online is not guaranteed.
Each product is presented by a descriptive sheet reporting all essential characteristics; the images and colors of the products offered for sale may not correspond exactly to the actual ones due to the settings of the IT systems used by the User to view the Site. Product images must therefore be understood as indicative and subject to normal tolerances of use.

All sale prices of products indicated on the Site include VAT, where applicable according to the country of shipment of the products, and any other tax that may be applicable to the sale.
Product prices may be subject to updates and changes. The User is required to verify the final sale price before submitting the relevant order. A manifest material error in the price shown on the Site compared with the commonly known price of the selected product entitles the Seller not to confirm shipment and to immediately refund the amount paid by the User, without the latter being able to raise objections in this regard.

Value vouchers are personalized codes that allow the User to benefit from a discount on purchases made on www.etruscagioielli.com.
Limitations on the use of value vouchers:
- The value voucher may only be used once, except in the case of returns;
- The value voucher may under no circumstances be converted into cash;
- It will not be possible to use more than one value voucher in the same order;
- The value voucher shall apply to only one item per order;
- The value voucher shall apply only to items whose sale value exceeds the value of the voucher itself by at least €1. It may not be applied to items belonging to the Sample Sale or charity sales.
If you wish to exercise the right of withdrawal provided for under Article 52 of the Consumer Code and return an item to which you have applied a value voucher, you must follow the standard return procedure available in the Returns section. Once your return has been accepted, the relevant code will be reactivated with its original value. The difference in price paid for the purchase of the item will be refunded to you according to the methods and deadlines provided for the standard refund procedure.
Value vouchers may not be available at the time of purchase; therefore, the User must verify the activation of the service before placing the order.

To pay the price of the products and the related shipping and delivery costs, if any, the User may follow one of the methods indicated in the order form.
In the event of payment by credit card, the payment procedure will take place through a secure connection directly linked to the banking institution that provides the online payment service, to which third parties cannot gain access. In particular, financial information (e.g. credit/debit card number, expiry date) will be sent via encrypted protocol to the parties providing the relevant remote electronic payment services, without third parties being able to gain access to it. Furthermore, such information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relevant refunds in the event of any returns of products following the exercise of your right of withdrawal, or where it becomes necessary to prevent or report to the police the commission of fraud on www.etruscagioielli.com. The price for the purchase of the products and the shipping and delivery costs, as indicated in the order form, will be charged to your current account at the time the purchased products are shipped, without prejudice to the User’s right to be reimbursed in the event of the Seller’s non-performance or failure to execute the contract for any reason.
The User is solely responsible for the data entered and therefore guarantees that they use only credit/debit cards that they are lawfully entitled to use.

Products are delivered, through affiliated couriers, directly to the User at the shipping address specified in the order.
By completing the personal data form in the order completion procedure necessary to activate the process for the execution of this contract and further communications, the User authorizes the Seller to communicate their personal data to the couriers and/or trusted shippers used for the delivery of the purchased products in order to enable the procedures necessary for their delivery.
The Seller will do its best to process the submitted order within 2 working days and in any case no later than 30 days from the day following the day on which the User submitted the order. Delivery times include only working days and do not include public holidays.
The Site allows the User to request delivery of the ordered products to an address different from their own, provided that it is within the country of shipment of the order; in any case, it is the User’s responsibility to indicate all references necessary for successful delivery. It is never possible to collect products purchased through the Site directly from the Seller’s warehouse.
Shipping costs and available shipping methods may vary depending on the country and the shipping method chosen by the User. Such costs and any additional charges are borne by the User. The relevant amount will be expressly and separately indicated in the order summary before the User proceeds with its submission, as well as in the order confirmation email.
The delivery procedure provides that, if the recipient is absent when the courier arrives, the courier will leave a notice in order to arrange the shipment subsequently, indicating the contact details to be used to arrange a second delivery. If no agreement is reached for the second delivery, the package will remain in storage at the courier’s warehouse and it will be the User’s responsibility to collect it. If the package is not collected within 4 days, it will be returned to the Seller. In such case, the contract shall be deemed terminated pursuant to Article 1456 of the Italian Civil Code, with notice from the Seller sent by email to the User, and the order will therefore be cancelled.
The User may always check the status of their order through the appropriate link by entering their order number or through their personal account area if they have previously registered on www.etruscagioielli.com.

It is strictly forbidden for minors to place an order on the Site. The data entered during the purchase process must be exclusively the User’s own real personal data and not those of third parties, nor fictitious data. The Seller reserves the right to take legal action against any violation and abuse, in the interest and protection of all consumers.
The User shall indemnify the Seller from any liability arising from the issuance of incorrect tax documents due to errors relating to the data provided by the User, since the User is solely responsible for entering the data correctly. Upon receipt of the products, the User is required to verify their conformity with the order. In particular, the User must pay attention to the correspondence between the number of packages indicated on the carrier’s document and those delivered, and to the integrity of the packaging. Any anomalies (e.g. tampering, damage) must be specified in writing directly on the courier’s transport document and the User must refuse delivery. At the same time, the User is required to report the matter to the Seller’s Customer Service through the appropriate link. If the User accepts delivery of tampered or damaged products, they shall lose the legal guarantee of conformity of the products.

The Seller assumes no liability for service disruptions attributable to force majeure, such as, by way of example, accidents, explosions, fires, strikes, earthquakes, and other events that prevent, in whole or in part, the performance of the contract within the agreed times.
The Seller shall not be liable to any party or third parties for damages, losses, or costs incurred as a result of the non-performance of the contract due to the above causes, the customer being entitled only to a refund of the price paid.
Likewise, the Seller shall not be liable for any fraudulent or unlawful use that may be made by third parties of credit cards, cheques, and other means of payment when paying for products. Indeed, at no time during the purchase procedure is the Seller able to know the User’s credit card number, which, through a secure connection, is transmitted directly to the provider of the banking service.

Products must be returned intact, undamaged, and provided with the barcode and any other seal that is part of the products; products returned incomplete, ruined, damaged, or deteriorated shall not be refunded.
In the event of exercise of the right of withdrawal, the Seller has the right not to accept the return or not to fully refund the sums paid for the purchase with regard to products that are without the relevant warranty tag (intended as a “security seal”) or that have been altered in their essential and qualitative characteristics or have been damaged.
Products intended to be returned must be delivered to the carrier within 14 days from the communication by the User to the Seller of their intention to withdraw from the contract.
The costs of returning conforming products shall be borne by the User. After the return of the products, the Seller shall carry out the necessary checks regarding their conformity with the conditions and terms indicated herein.
If the right of withdrawal is exercised correctly, the Seller shall refund any sums already collected from the User for the purchase of the products, net of shipping costs.
Whatever payment method has been used by the User, the refund is activated by the Seller as quickly as possible and in any case within 14 days from the date on which the Seller became aware of the exercise of the right of withdrawal, subject to verification of the correct exercise thereof and verification of the returned products.
The Seller shall make the refund using the same payment method used by the User for the purchase of the returned products, even where a virtual and/or single-use credit card was used. The Seller may not under any circumstances make a refund to a credit card different from the one used for the purchase, except where the card has meanwhile expired or been stolen: in such case, the User may send an email to customerservice@milor.it to agree on the most appropriate refund method.

Pursuant to law, the Seller is obliged to deliver to the User goods that conform to the sales contract, and the Seller is liable for any lack of conformity of the products existing at the time of delivery or appearing within two years from delivery.
For the above guarantee to be valid, the User must report the lack of conformity to the Seller within two months of discovery, under penalty of forfeiture, by contacting Customer Service through the appropriate link. The report must contain an accurate and complete description of the defects and faults complained of. Customer Service shall provide the User with instructions for returning the defective product, which shall take place at the Seller’s expense.
The User shall have the right to request termination of the contract and the return of the amount paid or, alternatively, replacement of the product. In the event of a minor defect/fault, the User shall only be entitled to replacement of the product. In any case, defects of conformity resulting from accidental damage or from the User’s responsibility for use of the product not in accordance with its intended purpose are excluded from the legal guarantee.

Any dispute relating to the application, execution, interpretation, and breach of sales contracts entered into through the Site shall be governed by Italian law. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. In any case, any rights granted to the Consumer by mandatory provisions of law in force in the State of residence or domicile of the latter shall remain unaffected.
